Alec Baldwin’s lawyer claims gun actor who shot and killed Halyna Hutchins has been ‘DESTRUCTED’

Actor Alec Baldwin’s lawyer has shockingly claimed that the gun used by the actor when he fatally shot cameraman Haylna Hutchins on the set of the movie Rust was destroyed by the New Mexico state government.

Alex Spiro dropped the bombshell in the case during a hearing held virtually and streamed on YouTube by the court on Thursday.

“I think I should tell the court that the firearm in this case, which is an important issue, was destroyed by the state,” Spiro said. “So that’s clearly a problem.”

Prosecutors did not respond to or refute Spiro’s claim, but New Mexico First Judicial District Attorney spokesman Heather Brewer denied the allegation.

“The gun used by Alec Baldwin in the shooting that killed Halyna Hutchins has not been destroyed by the state,” Brewer told DailyMail.com on Thursday. “The gun is in evidence and is available for the defense to review.”

The defense’s unexpected statement at the status hearing today that the weapon was destroyed by the state may be a reference to a statement in the FBI’s July 2022 firearms test report that damage was done to internal components of the weapon during its functional FBI tests. ,’ she added. “However, the gun still exists and can be used as evidence.”

Spiro added that he would like to be able to look at “what’s left of” the firearm, if anything.

The October 2021 incident occurred at a church building on the Bonanza Creek Ranch near Santa Fe, New Mexico, when Baldwin’s gun fired, the bullet killing Hutchins and wounding Director Joel Souza.

Baldwin denied pulling the trigger, but prosecutors have charged him with involuntary manslaughter for firing the gun while pointing it at Hutchins.

Hannah Gutirerrez-Reed was in charge of deploying the weapons. Both she and Baldwin have been charged with involuntary manslaughter and face 18 months in prison if convicted.

Court documents obtained by DailyMail.com show Baldwin’s attorneys tick the “not guilty” box when asked how he will plead.

He had been sentenced to five years in prison for a weapon addition to the charge, but that was dropped.

Now the actor risks up to 18 months behind bars.

According to the terms of a judge, Baldwin is not allowed to drink alcohol or own firearms.

There is no restriction on his travel, but he must keep in touch with his lawyer.

Production on the film will resume in Montana in the spring and will be shot at the Yellowstone Film Ranch.

Baldwin will continue to star and will also serve as producer.

He has always maintained that he did not pull the trigger and that the gun went off spontaneously.

He insists it was the gunsmith’s responsibility to make sure the gun was safe before handing it over to him.

However, prosecutors in New Mexico and the FBI say it would have been impossible to fire the weapon without him pulling the trigger.

They say he pulled the trigger on the same gun during previous rehearsals and drills.

Baldwin has already settled a civil lawsuit brought by Matthew, Halyna’s widower. Her family in Ukraine is now also suing him separately.
